On February 18, President Trump issued an executive order that will be welcome news to individuals and families considering IVF treatment.  The executive order recognizes that one in seven couples struggle with infertility and the emotional and financial struggles that an infertility battle often entails.  The order also notes that the average cost per IVF cycle can range from $12,000 to $25,000.

The President directs the Assistant to the President for Domestic Policy to submit a list of policy recommendations within 90 days targeted toward protecting IVF access and “aggressively reducing out-of-pocket and health plan costs for IVF treatment.”

So what does this order mean for families? By May 18, 2025, the Administration will be presented with what we hope will be a series of concrete, actionable policy recommendations for consideration that may help to increase access to IVF treatment and lower costs for families pursuing the treatment.

Here at Smith Strong, we have insight into the legal challenges that can come with IVF treatment.  This includes reviewing contracts with treatment facilities and embryo storage facilities to understand your rights under those agreements.  Our family law team can also advise on issues like what happens with stored embryos during a divorce.  We can also assist with embryo donation and embryo adoption.  And of course, we have our experienced estate planning team ready to ensure that your assets are protected and smoothly transitioned to your children in the future.

We will be closely following developments from this executive order, so stay tuned for more in the months ahead.  In the meantime, be sure to reach out to our team with any questions, or to schedule a consultation for legal matters surrounding fertility, adoption, and IVF treatments in Virginia.
